Anthropic is confronting a class action lawsuit alleging it misled customers about the usage included with its premium Claude Max AI subscriptions. The complaint, filed in U.S. District Court by customer Karl Kahn, alleges the company’s Max 5x and Max 20x tiers provided less access than advertised.
Kahn subscribed to Claude Pro before upgrading to Max 5x and later Max 20x. He alleges he overpaid for both subscriptions, received less usage than promised, and sometimes purchased additional usage after hitting plan limits.
The lawsuit argues Anthropic failed to clearly explain how usage was measured, making it difficult for subscribers to verify their access. “It’s really not easy for a normal consumer to know if they’re getting the amount they were promised,” said Kati Daffan of Vaca Daffan LLP, who is representing Kahn.
The legal action seeks damages, restitution, and injunctive relief for U.S. residents who purchased the plans since April 2025. It asks the court to certify a class action on behalf of those subscribers.
Anthropic offers several subscription tiers, with the Max plans costing $100 and $200 monthly for five and twenty times the Pro plan’s usage, respectively. The complaint asserts the marketing around these usage multipliers was deceptive.
The lawsuit emerges shortly after Anthropic launched its advanced Claude Fable 5 and Claude Mythos 5 models. That rollout drew user criticism over usage limits and the models’ tendency to consume subscription allowances rapidly.
